1. Organizer and Platform

The organizer of the giveaway is AGPN Arbeitsgemeinschaft präklinische Notfallmedizin e.V. Participation takes place exclusively via the website https://defi-league.de.

2. Object of the Giveaway

The objective of the giveaway is the recording and verification of locations of publicly accessible automated external defibrillators (AED) by the participants. To this end, participants upload photos of AEDs including a description of the location and, where available, GPS data via the website.

3. Participation Period

The giveaway begins on [Date, Time] and ends on [Date, Time]. The time of receipt of the submission via the website is decisive. Submissions received after the end of the participation period will not be considered.

4. Eligibility

Natural persons who have reached the age of 16 are eligible to participate. Each person may only participate with a single email address. Multiple registrations as well as the use of multiple accounts will lead to disqualification from the giveaway. Employees of the organizer, as well as persons involved in the implementation of the giveaway and their relatives, are excluded from participation, provided the organizer stipulates this in individual cases. Participation is free of charge.

5. Registration and Participation

Registration on the website is required for participation. During registration, only the following data will be collected:

  • An email address

  • A freely selectable username

Participation in the giveaway is carried out by uploading photos of defibrillators (AED) including a location description and, where possible, GPS data via the website.

6. Game Mechanics: Collecting and Verifying

6.1 Upload

Participants upload photos of defibrillators (AED) including a location description and, if applicable, GPS data to the website.

6.2 Review

Every submission is manually checked by the organizer’s team for accuracy, quality, plausibility, and location authenticity. A claim to points or consideration in the giveaway only arises after successful verification by the organizer. The organizer reserves the right to reject submissions, especially if they are:

  • Incomplete,

  • Technically deficient,

  • Implausible,

  • Submitted multiple times,

  • Not clearly assignable to a location, or

  • Incompatible with these Terms and Conditions.

6.3 Point System

The participant receives points for every successfully verified submission. At the end of the participation period, the collected points are converted into raffle tickets according to the key: 1 point = 1 ticket. Only submissions received by the end of the participation period and verified by the organizer by the time of the draw will be considered.

7. Safety and Rules of Conduct

To ensure the safety of participants and the proper operation of rescue facilities, the following rules apply:

  • No Trespassing: Entering private property, non-public business premises, or restricted areas is prohibited unless express permission has been granted.

  • Environmental Awareness: Participants must pay attention to their surroundings at all times. Searching for defibrillators must never take place in active traffic or in disregard of safety rules.

  • No Obstruction: Rescue routes, emergency exits, and access to the defibrillator itself must not be blocked at any time by the taking of photos.

  • Personal Rights: No persons, in particular bystanders, employees, or other third parties, may be recognizably depicted in the photos. The focus must be exclusively on the device and its location.

8. Exclusion in Case of Fraud and Manipulation

The organizer relies on fair play. Any attempt at fraud will lead to immediate disqualification from the giveaway and the forfeiture of all points and tickets already collected. This includes, in particular:

  • Submission of stock photos, internet images, or AI-generated images,

  • Manipulation of location data, in particular through GPS spoofing,

  • Multiple submission of the same location by the same participant,

  • Coordinated multiple submission of the same location through different accounts,

  • Intentional misinformation regarding the location,

  • Use of multiple email addresses or user accounts by the same person.

The organizer is entitled to exclude participants from participation if there is an objective reason.

9. Prizes

Physical prizes and vouchers will be raffled off among all eligible participants. A cash payment of the prizes, an exchange, or a transfer to other persons is excluded.

10. Determination of Winners and Notification

The draw will take place on a date yet to be determined among all participants whose submissions, received by the closing date, were successfully verified by the time of the draw. Each confirmed point corresponds to one ticket. The chance of winning therefore depends on the number of confirmed points. The winners will be notified by email at the email address provided during registration. If a winner does not respond within 14 days after the winning notification has been sent, the prize will be forfeited. In this case, the organizer is entitled to draw a replacement winner.

11. Delivery of Prizes

Depending on the type of prize, prizes will be sent by mail, electronically, or by other suitable means. Any additional information required for the delivery of the prize, in particular a shipping address, must be provided by the winner in a timely manner. Shipping is exclusively to addresses in Germany, unless expressly stated otherwise. The organizer accepts no responsibility for delays or non-deliverability based on incorrect information provided by the winner.

12. Usage Rights to Submitted Content

By uploading photos and location data, the participant grants the organizer the royalty-free right, unlimited in time, space, and content, to use the submitted photos and location data for non-profit purposes, in particular for documentation, publication, further processing, and provision for emergency physicians, rescue services, and public defibrillator maps. The participant warrants that:

  • They possess the necessary rights to the uploaded content,

  • The content does not violate any rights of third parties, and

  • No recognizable persons are depicted in the photos without their consent.

The location data and submitted photos may remain permanently in the organizer’s system insofar as they are required for the non-profit documentation and use of the AED location.

13. Data Protection

13.1 Controller

13.2 Processed Data

In the context of the giveaway, the following personal data in particular are processed:

  • Email address

  • Username

  • Uploaded content, insofar as it contains personal references

  • Technical usage data, insofar as it is necessary for the implementation and security of the giveaway

13.3 Purposes and Legal Basis

The processing of personal data is carried out for the purpose of conducting the giveaway, checking eligibility, verifying submissions, determining and notifying winners, and processing prizes. The legal basis is Art. 6 (1) (b) GDPR (performance of a contract or pre-contractual measures within the framework of the giveaway). Insofar as submitted location data and photos are further used for non-profit documentation purposes independently of the person of the participant, this is done on the basis of the usage right granted by the participant and, insofar as personal references exist, on a corresponding data protection legal basis.

13.4 Recipients of the Data

Personal data will generally not be passed on to third parties unless this is necessary for the implementation of the giveaway or for the delivery of prizes, or if the organizer is legally obliged to do so.

13.5 Storage Duration

The personal data of the participants, in particular the email address and username, will be deleted after completion of the giveaway and full prize processing, provided that no legal retention obligations exist. Location data and photos remain unaffected by this, insofar as they are permanently required in the system for the non-profit use, documentation, and provision of AED locations and no longer contain personal data or personal references have been removed.

13.6 Rights of the Data Subject

Participants have the right, in accordance with legal regulations, to:

  • Information about the processed personal data,

  • Correction of incorrect data,

  • Deletion,

  • Restriction of processing,

  • Objection to processing, provided the legal requirements are met,

  • Data portability, where applicable.

Furthermore, there is the right to lodge a complaint with a competent data protection supervisory authority.

14. Premature Termination, Adjustment, or Modification of the Giveaway

The organizer reserves the right to change, suspend, or prematurely terminate the giveaway in whole or in part at any time for good cause, provided that proper execution cannot be guaranteed for technical, legal, or factual reasons. This applies in particular to manipulations, misuse, security incidents, technical faults, or official orders. In such a case, participants have no claims against the organizer, as far as legally permissible.

16. Exclusion of Legal Recourse

Legal recourse is excluded.

17. Applicable Law

The law of the Federal Republic of Germany applies, excluding conflict of laws rules.

18. Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions remains unaffected. The invalid or unenforceable provision shall be replaced by the statutory regulation.
